In 1990 the musicians founded the FBO Gesellschaft des bürgerlichen Rechtes (a legal partnership), membership of which is confined to the orchestra musicians.

The partnership contract regulates both the orchestra's internal and external business. The business policy is determined at the partners' meeting: the currently 25 partners decide on the orchestra's musical development, the inclusion of new partners, the artistic director's proposals for their repertoire, fees, etc, etc.

Every two years, a board consisting of four musicians is elected at the partners' meeting. This board is charged with the management of the company and is responsible for the implementation of decisions taken at the partners' meeting.

The Freiburger Barockorchester is an institution subsidised by the City of Freiburg and by the state of Baden-Württemberg.
